The battle could also come down to taxes. Insiders claim the actor "has been trying to do everything legally within his power to avoid strong ties to New York City because the tax rates are ridiculously high."
One apparent loophole involved deeding one of his apartments to Holmes, who is now using the transfer last August to establish residency. That could leave Cruise open to higher taxes, making it more likely he'll push to have the divorce decided in California.
As for their presumably iron-clad prenup, E! News believes that it was structured to pay out on a timetable, so Katie could collect a chunk of change for making it to the five-year mark.
"I can't comment on that," Cruise's attorney tells the Los Angeles Times, adding ominously, "It will all come out. … I would hope that it's not a contentious matter. I know Tom is not a particularly contentious person."
Cruise might not be contentious, but the Church of Scientology is another matter. It's not exactly known to be a fuzzy little bunny when it wants something to go its way.
