Report: Officials Investigating Claims Made By Lindsay Lohan's Alleged Victim

  • The pedestrian who was reportedly struck by Lindsay Lohan's car in her latest hit-and-run case has accused the actress of slurring her words and reeking of alcohol during a verbal confrontation after the accident.

    But a law enforcement source tells NBC 4 New York that surveillance video footage of the incident indicates the man was barely touched by Lohan's bumper -- if he was even touched at all.

    The troubled star was driving her Porsche Cayenne into a hotel car park in Manhattan when she allegedly collided with Jose Rodriguez as he crossed a walkway, hitting his knee.

    Reports suggest a passenger in the car inspected the damage as Lohan walked into the nearby Dream Hotel, where she was attending an event.

    The victim reported the incident to police and the actress was arrested outside the venue in the early hours of Wednesday. She was booked for leaving the scene of the incident and was subsequently released without bail after being handed a desk appearance ticket.

    Rodriguez was admitted to the nearby Bellevue Hospital, where he was treated for torn tendons, and the chef has now spoken out about the run-in, insisting he did not recognize Lohan at the time of the collision.

    He remembers detecting the smell of booze during a brief conversation he had with Lohan immediately following the accident and says, "I asked, 'Why did you do that?' She said, 'You have to get out of the way.' She told me I had to move. She was slurring. She smelled like alcohol real bad. ... I didn't know who she was until people told me. I don't know why she couldn't just do the right thing."

    New York Police Commissioner Raymond Kelly tells the New York Daily News Lohan was not thought to have been intoxicated at the time of her arrest, although cops did not perform a Breathalyzer test. Authorities are currently investigating the validity of the alleged victim's account, according to NBC 4 New York.

    "While some of the facts are still being gathered, it appears that this is much ado about nothing," said Lohan's rep, Steve Honig, in a statement. "We are confident this matter will be cleared up in the coming weeks and the claims being made against Lindsay will be proven untrue."

  • The actress' father, Michael Lohan, has since hit back at Rodriguez's comments and given his support to Lindsay, who has battled drink and drug issues in recent years, claiming, "I think this is all a setup. I love my daughter and I believe her 100 percent."

    If the 26-year-old is convicted of the misdemeanor offense, it could constitute a violation her probation following the theft of a necklace from a jewelry store in Venice, Calif., last year.
