Eric Dane's Lawyer says Nude Video not a 'sex tape'

Eric Dane, best known for his role as Dr. "McSteamy" on "Grey's Anatomy," and wife Rebecca Gayheart can allegedly be seen having a threesome with former Miss Teen USA Kari Ann Peniche in a sex tape that has been leaked online.

Marty Singer, the couple's lawyer, told TMZ.com that he will sue anyone who publishes the "private, confidential tape," adding that "from what I've seen, it's a naked tape, not a sex tape."

Gawker's Defamer.com first reported on the sex tape by posting an edited version of the original 12-minute-long video.

The married couple and Peniche pass around the camera at the 25-year-old ex-beauty queen's apartment. In the clip, they appear intoxicated as they take a bath in a Jacuzzi tub and lay around naked in bed while discussing their porn names.

"My alter-ego name is Peter," Dane, 36, said, adding, "my dog growing up was called Cocaine, and I lived on Manor Drive, so I'm Cocaine Manor."

At one point, Gayheart, 38, says she has to lie down because she's "so high."

The tape reportedly surfaced as part of an official investigation into Peniche's alleged sex-for-hire business. In addition to posing for Playboy, she was also recently treated for sex addiction on Dr. Drew's "Celebrity Rehab" but was kicked off the show for apparently entertaining inappropriate guests and for stealing from her roommate, country singer Mindy McCready.
